Family Law in New Brunswick is not only about trials and court hearings. Often, such litigation does not offer the best route or solution to protecting the best interests of a child or the parties involved.   We counsel our clients to be aware of all their options as well as the cost and benefit of each.

 

There is much more to consider than just the time and cost. There is an emotional cost in addition to the effect that prolonged negative behaviour and poor communication can have on the children. Obtaining a Court Order for Custody or Access of a young child does not negate the fact that each parent will have to communicate with the other for many years to come.

 

Whether you want to have a Cohabitation or Separation Agreement prepared, adopt a child, or file for Divorce, you should have an appreciation of the big picture in addition to knowing the specific result you wish to achieve and the various options for reaching that resolution

A Will can be as simple or complex as the Testator chooses, but most people name family or friends as Executors and want to make sure their assets are left to the people they choose to receive them. Making a Will gives people the ability to choose who receives their assets after their death and will often save the surviving family members a great deal of time and money in administering the estate.

 

It is also important for people to consider making arrangements for the potential situation of incapacity during their lifetime. This could be due to a stroke, an accident, illness or for the simple reason that someone has assets in New Brunswick but will be absent from the Province for a prolonged period of time. We can help our clients discuss the benefits or necessity of Powers of Attorney for general (financial) purposes and for health care decisions. 

 

Any of these documents can be prepared alone or as part of an overall estate planning process. It gives peace of mind not only to the person for whom the documents are prepared but also for the family members who will likely be responsible for the care of the individual in the event of incompetence or death.

Jamie J. Feenan

 

Jamie was born and raised in England where he attended the University of the West of England, Bristol and in 2002 obtained his LL.B. with Honours. He completed his Post-Graduate Diploma in Bar Vocational Studies in 2003. After moving to New Brunswick he received his National Certificate of Accreditation in 2005 following his completion of studies at the law faculty of the University of New Brunswick in Fredericton and was called to the Canadian Bar and Law Society of New Brunswick in 2006.

 

Jamie J. Feenan is a Member of the Bar of England & Wales and the Canadian Bar Association as well as being a Member of the Law Society of New Brunswick, the Saint John Law Society and the Honourable Society of Lincoln’s Inn, London, England.
